Levin, Fishbein, Sedran & Berman specializes in representing plaintiffs in complex personal injury and class action cases on both a local and national level. Founded in 1981, the 12-attorney firm with its support staff has been involved in dozens of high profile complex actions. Among others, it has litigated on behalf of a certified nationwide class of public schools to recover the cost of remediation and abating asbestos contamination in public schools (the “Asbestos School Litigation”), the Ford Explorer SUV rollover case, the Bridgestone tire litigation, the Exxon Valdez Oil Spill litigation, the Three Mile Island nuclear radiation release litigation, and litigation involving the contamination of the town of Times Beach, Missouri with Dioxin that resulted in the forced closure of that town by the United States government through the EPA and the relocation of all of its citizens.
The firm has acquired vast experience and expertise in litigating a wide variety of complex cases that have involved both factual and legal challenges. This foundation has been put to great use by the firm as it has recently focused its formidable talents on litigating the many cases involving drug, medical device and pharmaceutical recall issues.
In the Diet Drug (“Fen-Phen”) Products Liability Litigation noted above, in addition to serving as lead class and liaison counsel, partner Michael D. Fishbein was and continues to be the chief spokesperson on behalf of the certified nationwide class and class counsel, accompanied by the support of his partners, Arnold Levin, Laurence S. Berman and Fred Longer. These counsel developed their expertise in the litigation of drug, medical device and pharmaceutical recall cases by their advocacy on behalf of clients in cases involving other drug and medical device products regulated by the FDA, including the Orthopedic Bone Screws Product Liability Litigation (where partners Arnold Levin and Michael D. Fishbein were lead counsel), the Rezulin Products Liability Litigation, the Propulsid Products Liability Litigation, the Dalkon Shield Litigation, the Sulzer Hip Replacement Litigation and the PPA Products Liability Litigation. The firm continues its representation of plaintiffs in this litigation area by pursuing claims on behalf of clients against the makers of Vioxx, Bextra and Baycol, while investigating potential claims against the maker of Celebrex.
Partner Arnold Levin had served and continues to serve on Plaintiffs' Steering Committees and Executive Committees of many important cases including: the Asbestos School litigation, the Silicone Gel Breast Implant Product Liability litigation, the Telectronics Pacing Systems, Inc. Accufix Artrial "J" Leads Products Liability litigation, the Norplant Contraceptive Products Liability litigation, the Rezulin Products Liability litigation, the Vioxx Products Liability Litigation and the Propulsid Products Liability Litigation. He and his partners Howard D. Sedran and Laurence S. Berman have also litigated against the tobacco industry for the creation of a program to monitor health related illnesses, which became a foundation for a tobacco settlement entered into in the state of California.
A hallmark of the Levin, Fishbein, Sedran & Berman approach has been to utilize its ability, experience and knowledge to manage large cases, often involving parallel state and federal court proceedings or Multidistrict Litigation in federal court, without losing contact with the individual client.
As an experienced, professional team, the firm also provides superior representation to plaintiffs in antitrust and price fixing class actions, where its partners, including Howard J. Sedran, have attained leadership roles on Executive and Steering Committees, such as in the well known “Sunday Ticket” litigation involving the National Football League’s method of broadcasting games and required package sales.
The firm also represents individual plaintiffs in serious medical malpractice, product liability, vehicular accident, premises liability and admiralty cases. It has successfully litigated claims for merchant seaman for injuries suffered on board vessels, and hospitals and doctors for causing catastrophic malpractice injuries.
